Terms

This is how working with LAB59 goes, in plain English. No tricks, no fine print hiding in a footnote.

Your quote is the main agreement. If it says something different from this page, the quote wins.

Who you're dealing with

LAB59 is a Brisbane business run by me, Gary Titmarsh, as a sole trader. When this page says "I" or "LAB59", that's me. When it says "you", that's you, or the business you're buying for.

LAB59 is not currently registered for GST. Prices are in Australian dollars, and your quote will say if that changes.

What you're buying

A simple, fast website built for your business, and where it's in your quote, help with your Google Business Profile. It's a one-off price. The quote lists exactly what's included, such as the pages and any extras.

Quotes are valid for 30 days. If you want something that isn't in the quote, I'll tell you before I do it and give you a price. Nothing gets added to your bill as a surprise.

Changes while I'm building

Two rounds of changes are included. A round means tweaks to what I've already built, like wording, photos, colours or layout of a page. A completely different direction or a lot of new pages is new work, and I'll quote it separately.

What I need from you

Dates I give you are my best estimate, not a fixed deadline, unless we've agreed otherwise in writing.

Checking before it goes live

Before launch, I'll send you the site to review. Please read it properly: spelling, prices, opening hours, phone numbers, addresses and anything that makes a claim about your business. You know these details better than I do. Once you give the go-ahead, I'll publish what you approved.

Paying

The quote sets out the price and when it's due. If I need a deposit before starting, the quote will say so. Invoices are due by the date shown on them.

If you stop a project part-way through, you pay for the work done up to that point. If you're owed a refund, you'll get it. Your rights under Australian law always apply, and nothing here cuts them down.

Who owns what

Once you've paid in full, the finished website and everything I made specifically for you is yours.

I keep ownership of my own tools, templates, code I reuse across projects and general know-how. Fonts, images and other third-party material stay under their own licences.

You keep ownership of everything you give me. You let me use it to build and run your site, and nothing more.

Hosting, domains and handover

Your site is static, so there's no database, no logins and no plugins to keep updated. It's hosted on Cloudflare, and there's no ongoing hosting charge from me unless your quote says otherwise.

You should own your domain name, in your name, with your login. If I register one for you, it's registered to you, and I'll give you the details.

After you've paid in full, I'll hand over the site files whenever you ask. If you want the site moved to hosting accounts of your own, I'll help, and I'll quote it first if it's more than a quick handover.

Cloudflare, GitHub, Google and other platforms are outside my control. They can go down, change prices or change their rules. If something changes that affects your site, I'll tell you and we'll work out the options together.

Your Google Business Profile

Where I help with your Google Business Profile, it stays yours, in your name, with you as the owner. Google decides what gets verified and what the rules are, and I can't speed that up or overrule it.

After launch

If something I built doesn't work the way we agreed, I'll fix it at no charge.

If you want content changes later, like new text, new photos or a new page, they're paid work. I'll give you a price before I start. Because the site is static, you don't need to keep paying for maintenance just to keep it online.

No promises about results

A clear website and a well-kept Google Business Profile make it easier for people to find you and trust you. I can't promise a particular number of calls, customers, sales or a Google ranking. Too much of that depends on things I don't control, like your market, your prices, your competitors and Google itself.

Showing my work

Once your site is live, I may show it on lab59.com.au and in proposals to other businesses, with screenshots or a link. If you'd rather I didn't, tell me in writing and I won't.

Your information

I only use what you give me to do the work for you. I keep it private, I don't sell it, and I only share it with others where it's needed to build or run your site, like hosting, or where the law requires it.

Australian Consumer Law

Nothing on this page limits any right or remedy you have under the Australian Consumer Law or any other law that can't be excluded. That includes your right to services provided with due care and skill.

Liability

I take care with every site I build. To the extent the law allows, I'm not liable for indirect losses I couldn't reasonably have foreseen, such as lost sales. I'm also not responsible for problems caused by information you supplied, by changes someone else made to the site, or by outages on third-party platforms.

If we disagree

Talk to me first. Email me what the problem is and what you'd like to happen, and I'll do the same. Most things get sorted that way. This doesn't stop either of us from using any legal right we have.

Changes to this page

I may update these terms from time to time. The version in place when you accept your quote is the one that applies to that job.
